2. Object and scope of application

 

The following General Terms of Hire and Use are applied to the visitors of PHILIPPA MARQUIS and as well as any transactions of a comercial nature made by the Client, through our online store.

 

While browsing the website, as well as when purchasing any product in the online story, the Client preliminarily declares that the purchases made are for purposes other than the Client’s commercial or professional activity, that they agree with and accept the present General Terms of Hire and Use by the User and the Client.

 

PHILIPPA MARQUIS has the right of changing these General Terms of Hire and Use without previous notice, and any changes made are published in the website.

 

 

3. Responsibilities and cases of force majeure

 

Every Product commercialized in the website www.philippamarquis.pt are in compliance with the Portuguese legislation.

 

PHILIPPA MARQUIS declines any responsibility should there be any violation of legislation from the country where the parcel is delivered. It is the Client’s obligation to check with the local authorities the import or use conditions regarding the products he/she wishes to order.

 

PHILIPPA MARQUIS is not responsible for any direct, indirect, accidental or exceptions damage resulting from the use of their products.

 

PHILIPPA MARQUIS is not responsible for damages that result from any interference, interruptions, informatic viruses, malfunctions or disconnections from operating system that may impede, temporarily, the access, browsing or providing its services to Users.

 

PHILIPPA MARQUIS will not, in any case, be responsible for the content, function or other terms within other websites that you may access through the website www.philippamarquis.pt, nor the contents, services or products offered by them.

 

PHILIPPA MARQUIS is not responsible for fortuity or force majeure, resulting from unforeseen events or natural causes foreign to human action, unavoidable situations or situations that make it impossible to provide our services, which may not be imputable or attributable to PHILIPPA MARQUIS, namely situations such as natural catastrophes, terrorist attacks, war, and epidemics, among others. Whenever this occurs, PHILPPA MARQUIS will take the necessary measures, so as to inform the clients, with immediate effect and as soon becomes aware, about the circumstances and foreseeable consequences of that impossibility.

 

 

4. Product information

 

PHILIPPA MARQUIS commercializes handcrafted products made by us, as well as non-handcrafted products, handled and changed by us. The information on the origin of each product will be specified in the products respective page.

 

The availability shown in PHILIPPA MARQUIS is not binding, since the quantity shown may not indicate the real stock in storage.

 

Should the ordered product be no longer in stock, PHILIPPA MARQUIS will inform the Client and specify the amount of time necessary to make and send the product or, if the Client does not want to wait, will make a full refund of the amount paid.

 

The product image may not be a perfect representation of its characteristics, as it may differ in size, colors, small details and accessories that are shown in the photo. The prices, photos and descriptions within the PHILIPPA MARQUIS’s catalog may be changed at any time and without previous notice. All changes take effect when they are published

 

PHILIPPA MARQUIS informs you that the prices shown in the website are valid only for the day they are announced and all purchases made in that date, even if they are received at a later time, and are subject to the stock availability. All promotional campaigns have specific conditions and a limited and exclusive stock for the online commercialization.

 

 

5. Purchasing online

 

In order to purchase online at PHILIPPA MARQUIS, it is necessary to register as a Cliente, through the creation of a personal account and by filling out the form for that effect. After the registry, all that is necessary is to insert in the virtual shopping cart all the articles you wish to acquire. The Client should follow all the purchase steps so that is successfully completed.

 

All prices practiced include VAT at the legal rate in effect, which may differ from the prices applied on the physical display of the product.

 

Confirming a purchase request implies that the Client expressly knows and accepts, these General Terms of Sale (Hiring, Using, Exchanges and Returns), available for consultation at the website.

 

As soon as you complete your purchase, you will receive na automatic e-mail confirming the transaction. Should de data be incorrect you may request their change immediately, or even, the cancelation of the completed purchase.

 

When purchasing commercialized products at the website, PHILIPPA MARQUIS accepts the following payment methods:

After completing the order, the Client has 3 days to go ahead with its payment. PHILIPPA MARQUIS recommends that the Client informs when the payment has been completed, by sending a document proving it, so as expedite the product shipping. After the payment has been confirmed, the parcel will be dispatched within 1-5 business days.

 

The parcel’s invoices will be sent via e-mail or on paper, after an express request has been made by the Client, and from the moment the parcels are dispatched.

 

 

6. Shipping

 

The detailed information on shipping options, foreseen delivery times and the shipping process is detailed on the “Shipping Options” page.

 

Every detailed delivery time are estimates of the delivery dates mentioned by the shipping company regarding their service under normal conditions. Any delays on delivery caused by the shipping company will not be, in any way, attributable to PHILIPPA MARQUIS.

 

The available delivery methods and respective delivery times may change according to the time of the year. The delivery methods and respective deadlines can be confirmed in the virtual Shopping Cart.

 

Usually, the available products are sent within 1-5 business days. Any delays, due to exception conditions, will be communicated immediately to the Client via e-mail. The personalized orders will be processed according to the times agreed with the Client directly.

 

The particularly urgent orders may, in some cases,be satisfied, but only when expressly requested by the Client and previously agreed with PHILIPPA MARQUIS, before an order is concluded.

 

The Client exempts PHILIPPA MARQUIS from any liability in case of theft, damage and loss of the order.

 

PHILIPPA MARQUIS will ship the ordered products to the address indicated as “Shipping Address”. If the address provided by the Client is incorrect any storage, return or reshipping costs to a different address will be charged to the Client.

 

In case of a repeated inability to deliver, at the address indicated by the Client, the order will be returned to PHILIPPA MARQUIS. Any reshipping costs will be charged to the Client.

 

It is possible that a second order is combined with a first so as not to pay the cost of the second shipping, as long as the first has not been concluded yet. In this case, it should be requested in advance via e-mail to: philippamarquis@gmail.com.

 

 

7. Cancelations, exchanges and returns

 

The following conditions and terms are only applicable on purchased made at the website www.philippamarquis.pt.

 

 

      7.1. Cancelation policy

 

The Client may cancel his/her order at any time until its shipping confirmation is received, with the right to a full refund of the paid amount.

 

Failing to pay for the order within the 3 days following the date where it was completed implies its automatic cancelation.

 

According to the terms within the nº7/2004 Decree-Law of 7th January (with the changes conferred by the Decree-Law nº 62/2009, 10th of March and the Law nº 46/2012, of 29th August), regarding electronic commerce, PHILIPPA MARQUIS holds the right of unilaterally cancel the order, every time that a programming error occurs.

 

PHILIPPA MARQUIS’s computers have work defects as well as contract proposal arrives deformed to its destination and the error focuses on an essential element of the contract.

 

 

      7.2. Return policy

 

The Client that has acquired a product at PHILIPPA MARQUIS, with terms of the law, Right of Free Resolution, has a deadline of 14 days to proceed with its return, starting from when the parcel is received, as per the terms in the Decree-Law nº 24/2014, from 14th February. He/She may request it, as long as the following conditions are met:

 

- Presenting proof of the order made and product payment;

 

- The product must be returned in the same conditions as it was sent – intact, without any signs of wear, dirt, exterior damage or signs of use, completed with all its parts/accessories and cushioned in the respective original package, stored according to the normal diligences, without any signs of tampering.

 

In order to do so, the Client must contact Customer Support, through the electronic address: philippamarquis@gmail.com, and communicate his/her intent to return the product, specifying the reason of return. The Client must not, in any situation, send to PHILIPPA MARQUIS the products without having made a previous contact, for they will not be accepted.

 

Should the Client make use of the Right of Free Resolution, he/she will support all costs associated to the product’s return.

 

From the Right of Free Resolution, within the mentioned 14 days deadline, the contracts of:

 

- personalized products or products made according with the Client’s specifications;

 

- products that, by nature, cannot be reshipped or are susceptible to deterioration;

 

If it is confirmed that the product’s return is due by an error made by PHILIPPA MARQUIS, the full paid amount will be refunded, including the shipping costs for product deliver and return.

 

Return Process

 

The Client must return the products, without unjustified delay and no later than 14(fourteen) days counting from the day he/she informed PHILIPPA MARQUIS of the contract’s free resolution. Outside of the free resolution context, no returns are accepted.

 

After contacting Customer Support, through the e-mail address: philippamarquis@gmail.com, all the information regarding the return process will be provided.

 

After receiving the product and verifying its state, an e-mail will be sent to the Client informing the acceptance or non-acceptance of the product’s return.

 

Should the product’s return be accepted, PHILIPPA MARQUIS will also, within the deadline of 14 (fourteen) days after receiving the product, return the total paid amount after verifying the product’s integrity. The transaction will occur through the means agreed with the Client. The initial shipping costs will not be refunded.

 

The return acceptance is, however, subject to the following conditions:

 

- The returned product must be intact and within its original package, complete with all its parts/accessories. The product must properly packaged when returning;

 

- Upon arrival, the product will be examined to evaluate any damages or tampering that were not caused by transportation. However, if there are damages caused due to bad packaging during the transport, PHILIPPA MARQUIS will keep part of the due refund.

 

 

      7.3. Exchange policy

 

The Client that had acquired a product at PHILIPPA MARQUIS has a deadline of 14 days from receiving the parcel to request its Exchange for another product. He/She may request it, as long as the following conditions are met:

 

- Presenting proof of order the Client made and product payment;

 

- The product must be returned in the same conditions that it was sent – intact, without any signs of wear, dirt, external damage or signs of use, complete with all its parts/accessories and packaged in its respective original package, stored acording to the normal diligences, without any signs of tampering.

 

The Client must contact Customer Support, through the e-mail address: philippamarquis@gmail.com, and inform his/her intent to exchange the product. The reason for exchange and the product desired as replacement must be mentioned. Any product sent for exchange before contacting Customer Support, will be refused.

 

When exchanging products, the Client will support all shipping costs for the product to be exchanged and the new product to be shipped.

 

The following articles are not accepted for exchange:

 

- personalized products or made according to the Client’s specifications;

 

- products that, by nature, cannot be reshipped or are susceptible to deteriorate.

 

Exchange Process

 

The Exchange process should proceed as follows:

 

The Client must return the products, without unjustified delay and, at latest, 14 (fourteen) days starting from the day PHILIPPA MARQUIS was received the Client’s exchange request.

 

After contacting Customer Support, through the e-mail adress philippamarquis@gmail.com, all information for the exchange will be provided.

 

After receiving the product and verifying its state, an e-mail will be sent to the Client, confirming the acceptance or non-acceptance of the product exchange.

 

If the product exchange is accepted, the Client will be informed via e-mail about the cost of the difference between the product to be exchanged and the new product to ship as well as the associated shipping costs. If the difference is in favor of the Client, the refund of the respective value will be made through means agreed with the Client. If the difference is in favor of PHILIPPA MARQUIS, the Client will be requested to pay for the difference through the payment methods specified at the website.

 

After refunding or receiving payment of the difference between products, PHILIPPA MARQUIS will, within 14(fourteen) days, send the new product. The initial shipping costs will not be refunded and the new shipping costs will be paid for by the Client.

 

Product exchanges are only accepted if they are in the following conditions:

 

- The product to be exchanged must be intact, without signs of use and in the original package, complete with all its parts/accessories;

 

- The product to be returned must be properly packaged.

 

 

8. Warranty

 

According with the terms in the Decree-Law nº 67/2003, from 8th April, with changes introduced by the Decree-Law nº 84/2008, from 21st May, all commercialized products at PHILIPPA MARQUIS, are covered by a goods conformity warranty with the duration of 2 (two) years.
